Safari, Activities & Adventure Waiver and Release of Liability

Before joining us on your safari or adventure experience, we require each guest to review and accept the terms outlined in our waiver.

This form confirms that you understand the inherent risks involved in safari travel and related activities, and that you voluntarily agree to the terms and conditions provided by Photo Safari Company.

1. Acknowledgment of Risk

I acknowledge and accept that participation in any safari, activity, or adventure tour arranged by Photo Safari Company involves inherent risks and hazards. These may include, but are not limited to:

Encounters with wild animals and unpredictable wildlife behavior
Travel by open safari vehicles, charter flights, mokoro (dugout canoe), helicopter, or boat
Participation in physically demanding or high-risk activities such as walking safaris, scenic flights, white-water rafting, hot air ballooning, cultural village visits, bush dinners, and other outdoor excursions
Exposure to harsh or unpredictable weather and terrain
Medical emergencies in remote locations with limited access to immediate healthcare

I freely and voluntarily accept all such risks, both known and unknown, and understand that these risks are part of the experience.

2. Release of Liability

In consideration of my participation, I hereby release and forever discharge Photo Safari Company, its directors, guides, employees, representatives, agents, independent contractors, and affiliated operators from any and all liability, claims, demands, losses, or damages arising from:

Personal injury or illness (including COVID-19 or other contagious diseases)
Death or disability
Property loss, theft, or damage
Delays, interruptions, or changes to itineraries beyond the company’s control
Accidents involving wildlife, vehicles, aircraft, boats, or during participation in any activity or adventure

This release applies regardless of whether the injury, loss, or damage is caused by negligence or otherwise.

3. Adventure & Activity Participation

I understand that additional risks may arise from participation in activities and tours including, but not limited to, game drives, walking safaris, boat cruises, mokoro canoe trips, hot air ballooning, helicopter flights and landings, scenic flights, white-water rafting, cultural excursions, photography tours, and any other adventure-based, wildlife-related, or physically demanding experiences arranged or facilitated by Photo Safari Company.

I confirm that I am voluntarily participating in such activities and tours, acknowledge the inherent risks involved, and agree to follow all safety briefings and instructions provided by guides, staff, or third-party operators.

I understand that I may decline participation in any specific activity at my discretion.

I further confirm that:

I am participating voluntarily
I am physically fit and capable of taking part in these activities
I will follow all safety instructions and briefings provided by guides and operators
I may opt out of any activity at my discretion if I feel unsafe or unwell

4. Third-Party Operators

I acknowledge that Photo Safari Company works in partnership with third-party suppliers (including but not limited to lodges, air charter companies, local activity operators, and accommodation providers) and is not responsible for their actions, omissions, or policies.

I agree to abide by any additional terms and conditions set by these providers and accept that Photo Safari Company is not liable for incidents that occur under their control.

5. Insurance & Medical Responsibility

I confirm that I have, or will obtain before travel, comprehensive travel insurance that includes:

Emergency medical evacuation
Repatriation
Medical treatment
Trip cancellation/interruption
Personal liability
Coverage for adventure activities

I understand that participation in any safari or activity is conditional upon having adequate insurance.

I accept full responsibility for any medical costs or consequences arising from my participation. info@photosafaricompany.com

6. Health & Fitness Declaration

I declare that I am in good physical condition and do not suffer from any condition that would prevent me from safely participating in safari activities or adventure excursions. I have disclosed any relevant medical conditions, allergies, or mobility limitations to Photo Safari Company or my tour consultant prior to departure.

9. Jurisdiction

This waiver is governed by the laws of Queensland, Australia, and any legal disputes arising under this agreement shall be subject to the jurisdiction of the courts of Queensland.
